Restoring & Maintaining Trust: Lead Generation Self-Regulation To Protect Consumers And Preserve Competition

For decades, American businesses both large and small have relied on lead generation services to put them in contact with consumers seeking their products or services. This is even more true in the internet era, where consumers typically choose to begin their search for products and services online and expect to find online sites where they can compare brands.


During that time, high-quality lead generators demonstrated they were a highly valuable component of the advertising market. At the same time; however, bad actors manipulated the business models employed by legitimate lead generators and created deceptive and fraudulent schemes that violate consumer privacy rights and jeopardize the industry as a whole. These bad actors operate in what Federal Trade Commission (“FTC”) Consumer Protection Bureau Director Andrew Smith rightfully declared an “ecosystem of deceit” as he announced the FTC’s latest regulatory plans to bring that behavior to an end.

PACE Regulatory Alert: Compromise Robocall Bill Release Imminent

House and Senate leaders announced late last week that a compromise robocall bill, called the Pallone-Thune TRACED Act, will be released very soon.  For some time now, Congress has been working toward an anti-robocall bill. Last May, the House passed its version called Stopping Bad Robocalls Act (“SBRC”), and the Senate passed its own version called the TRACED Act. Both bills passed their respective chambers with overwhelming majorities. Although they have many similarities, they also have some major differences.

Pennsylvania Amends Telemarketing Registration Act

The Governor of Pennsylvania has signed House Bill 318 amending the state’s Telemarketing Registration Act. Please note, the Act is now more restrictive in several of its requirements than the Telephone Consumer Protection Act (TCPA) and the Federal Do Not Call Registry (DNC).

Lead Generation Under Scrutiny By FTC

The Federal Trade Commission (FTC), under the leadership of Director Andrew Smith, continues to focus its consumer protection enforcement efforts on the lead generation industry.  As we reported last Spring, the FTC is cracking down on companies that generate or purchase consumer data gathered without the proper consent and that “big, responsible companies” are no safer from FTC scrutiny than fly-by-night advertisers. In its most recent enforcement action, the FTC  announced today that it entered into a Stipulated Order (Order) with several companies in the for-profit education sector. The Order provides a roadmap for compliance for both lead generators and sellers alike.

FCC Chairman Proposes Default Call Blocking to Combat Robocalls

In a statement released yesterday, Federal Communications Commission Chairman Ajit Pai announced plans for a bold declaratory ruling that would allow phone companies to block robocalls to their customers by default. Chairman Pai encouraged carriers, if the decision is adopted, “to begin providing these services by default – for free – to their current and future customers.” The details of the proposed declaratory ruling have yet to be released.
